Doping Control Regulations

Issued pursuant to Section 4
of Paragraph five of Article 6 of the Sports Law

I General issues
1. These Regulations determine the doping control procedure.
2. Doping control is carried out in order to establish presence of doping substance in the body of or use of doping method, which are determined by appendix 1 of this regulation, by an athlete

II. Institutions involved in doping control and their actions
3. Doping control activities are co-ordinated by Antidoping Committee. Antidoping Committee is a consultative institution in the field of doping control.
4. In the Antidoping Committee the representatives of Ministry of Education and Science, Ministry of Health, Latvian Olympic Committee and Sports Federation Council of Latvia are included. Personnel of Antidoping Committee are approved by the Minister of Health.  Antidoping Committee is led by committee chairman. Chairman of Antidoping Committee is a representative of Ministry of Health. Experts may be invited to the Committee meetings with advisory role.
5. Antidoping Committee is entitled to accept decisions if in its meeting not less than half of Committee members are present. Each Committee member has one vote.
6. Antidoping Committee accepts its decisions by open voting. Decisions are accepted by simple majority. In case of tie-vote, decisive is chairman's vote.
7. Secret voting is carried out, if it is requested by not less than one third of Antidoping Committee members.
8. Meetings of Antidoping Committee are recorded.
9. Antidoping Committee has the right to initiate doping control during competitions to any athlete according to its own initiative or according to the application of a sports federation, international sports federation, Latvian Olympic Committee or Sports Federation Council of Latvia.
10. Antidoping Committee within two working days after reception of such application issues a resolution to Sports Medicine State Agency (further - Agency) to carry out doping control.
11. Out-of-competition doping control is carried out to the athletes in accordance with the doping control plan established by Agency. Doping control plan is twice a year forwarded to Antidoping Committee for review.
12. Establishing out-of-competition doping control plan Agency uses data on athletes training and competition venues and times, their achievements, former doping controls and their results, possible connection of the representatives of certain sports with use of doping substances and methods and other information.
13. In order to carry out doping control, Agency based upon the application mentioned in Article 9 or doping control plan mentioned in Article 11, collects urine or blood sample of respective athlete in accordance with these regulations.
14. Urine or blood sample of the athlete can be collected by a person, who has a proxy issued by the director of Agency (further - doping control officer). Blood sample can be collected only by certified medical person.
15. Director of Agency issues a written proxy to the doping control officer. Agency provides doping control officer with information concerning time and place, where respective athlete can be met, as well gives necessary equipment and documentation for doping control.

III. Procedures before doping control
16. Doping control officer instructs the athlete about the application mentioned in Article 9 or an extract of doping control plan, presents his/her license and proxy, as well as a notification to the athlete on necessity to submit to doping control.  The athlete presents identification card and signs the notification. In case of minor, the notification must be signed by legal representative of minor.
17. Doping control officer informs the athlete about the doping control procedure, venue of doping control, as well as on his/her rights to be accompanied with one person during doping control. In case of minor, doping control is carried out only in the presence of legal representative of minor.
18. If the doping control officer can not meet the athlete in the time and place given by agency three times within seven days or the athlete refuses to sign the notification, doping control officer in written reports about it to the Agency.
19. Doping control officer ensures the arrival of the athlete to the doping control venue not later than one hour after reception of notification and continuous observing of the athlete during doping control. If the athlete takes part in press conference or awarding ceremony, athlete can arrive to the doping control venue later.
20. Doping control officer records the time of arrival of the athlete to the doping control venue
21. Agency ensures that doping control venue will respond the following criteria:
21.1. Separate room for doping control;
21.2. Separate room where athlete can prepare for doping control and where the opportunity to hydrate is provided;
21.3. Separate toilet, in case of collection of urine sample.
22. For doping control sample collection vessels, doping control kits for urine and for blood are used. Each item of the doping control equipment must be in sealed packing to provide that they are untouched. After sample collection samples are sealed using special doping control equipment with unique coding system.
23. If an athlete fails to submit to sample collection for doping control, doping control officer fills in the protocol of administrative offence and sends it to the State Education Inspection and informs Agency.

IV. Urine sample collection
24. For urine sample collection the doping control officer invites the athlete to choose one of the urine collection vessels in sealed package and to make sure that the package is not broken. If the athlete insists that the package is broken, he/she has rights to choose another vessel.
25. The athlete gives the sample in the toilet under observation of the doping control officer of the same gender.
26. Urine sample volume is at least 75 milliliters. If the sample volume is less than 75 milliliters, collection vessel is temporarily sealed in the kit chosen by the athlete from several kits. After collection of necessary volume both samples are poured together
27. After urine sample collection doping control officer invites the athlete to choose one of several urine doping control kits and make sure that the code numbers on all parts of the kit (A and B) are the same and that the package is not broken. If the athlete insists that the numbers are not the same or package is broken, he/she has rights to choose another kit.
28. According to the instructions of doping control officer the athlete pours two thirds of the sample in bottle A and one third in bottle B, closes the bottles and seals the sample screwing the bottle or putting the bottle in special container.
29. Doping control officer uses the left over urine sample in the collection vessel to measure the specific gravity and pH of the sample. If specific gravity or pH does not comply with the norms set by Agency, sample collection is repeated and both samples are considered as doping control samples.

V. Blood sample collection
30. Before the blood sample collection doping control officer ensures that the athlete can rest for at least 10 minutes in a comfortable position
31. Doping control officer invites the athlete to choose one of several blood doping control kits and make sure that the code numbers on all parts of the kit are the same and that the package is not broken. If the athlete insists that the numbers are not the same or package is broken, he/she has rights to choose another kit.
32. Doping control officer cleans the athlete's skin with sterile disinfecting pad in the area where venopuncture will cause less influence to the athletes sporting activities. Doping control officer collects blood sample in tube from superficial vein (using tourniquet if necessary). If tourniquet was used, it must be removed right after venopuncture and on the area of puncture is covered by a bandage.
33. Blood sample volume in each tube is at least three milliliters.
34. If the sample collected in first attempt is less than three milliliters, doping control officer makes other attempt, but not more than three attempts altogether. If the sample volume is still not sufficient, the sample collection is terminated and doping control officer informs Agency in written about it.
35. Athlete inserts the tubes with blood samples in special containers or boxes and seals them according to the instructions of doping control officer.

VI. Procedures after doping control
36. Doping control officer fills in the doping control form (Appendix 2).
37. Doping control form (original and two copies) doping control officer in the next working day after doping control hands in to the Agency and attaches the samples collected during doping control, as well as all other documents connected with the control. Athlete gets copy of notification and one copy of doping control form.
38. Agency sends the sample, letter and special copy of doping control form to the laboratory accredited according to the criteria of Monitoring Group of Antidoping Convention of Council of Europe (further laboratory). Special doping control form copy for the laboratory contains information on sport, date and time of sample collection, sample volume, specific gravity and pH, urine or blood doping control kit number, athlete's information about the medication used during past 10 days.
39. Laboratory analyses the A sample on presence of all prohibited substances and methods in case of competition doping control, and only substances in the Appendix 1 under Articles S1 to S5 and M1-M3. Laboratory can make additional tests if the organization requesting doping control has requested other substances to be detected. After sample analysis laboratory sends a report to the agency.
40. If laboratory report states that in A sample no adverse analytical finding has been detected, Agency sends to the athlete and his/her federation copy of doping control form and laboratory report.
41. If laboratory report states that in A sample adverse analytical finding has been detected, or doping control officer has reported to the Agency that athlete has failed to submit to doping control or refused to sign the notification or is unavailable for doping control, Agency submits to the Antidoping Committee a proposal on possible antidoping rule violation. To such proposal laboratory report, doping control form, other information is attached.
42. Antidoping Committee within two working days reviews the proposal, mentioned in Article 41 and attached documents, and issues a resolution to the Agency about antidoping rule violation.
43. If the arguments explained in the proposal of the Agency are not sufficient to decide whether or not an antidoping rule violation has occurred, Antidoping Committee requests the explanation of involved persons or informs the athlete on possibility to make B sample analysis. In such case the athlete or his/her representative can be present during B sample analysis in the laboratory.
44. If Antidoping Committee after reviewing the proposal of Agency decides, that there was no antidoping rule violation, it issues a resolution to the Agency. Agency sends to the athlete and his/her federation copy of doping control form, laboratory report and Antidoping Committee resolution.
45. If Antidoping Committee after reviewing the proposal of Agency decides, that there was an antidoping rule violation, it sends to the athlete and his/her federation information about the violation, copy of doping control form, laboratory report and other relevant information by registered mail. In case of use of substances S6-S8, Antidoping Committee sends a report to the law enforcement institutions by registered mail.
46. If the resolution of Antidoping Committee state that athlete has refused or failed to submit to doping control, information about it Antidoping Committee sends to the State Education Inspection by registered mail.
47. If the application on doping control has been issued by a sports federation, international sports federation, Latvian Olympic Committee or Sports Federation Council of Latvia, costs for the doping control are covered by respective institution.
48. If the doping control is carried out on initiative of Antidoping Committee or according to the doping control plan, costs for the doping control are covered by Agency.

VII. Compliance with the regulations and responsibility on its violence
49. Agency organizes and co-ordinates antidoping activities of state, municipal and private organizations and carries out the doping control according to these regulations.
50. State Education Inspection to imposes administrative penalties on violation of doping control regulation.
